1. Acceptance of Terms
By accessing or using Dowser (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Dowser is a walking discovery app that generates scored walking routes to interesting destinations based on your selected theme and current location. The Service uses a directional arrow and haptic feedback to guide you — no map is shown by default.
Please understand that:
- Routes are algorithmically generated suggestions, not guaranteed paths
- Venue availability, hours, and conditions may change without notice
- Destinations are scored using publicly available data and may not match your personal preferences every time
- The Service requires an active internet connection for route generation and GPS for navigation
3. User Accounts
You must sign in using Google Authentication to use Dowser. By creating an account, you agree to:
- Provide accurate information through your Google account
- Maintain the security of your account
- Notify us of any unauthorized access
- Accept responsibility for all activity under your account
One account per person. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
Permitted Use
You may use Dowser for:
- Personal, non-commercial walking exploration and discovery
- Rating destinations to improve future recommendations
- Syncing preferences with the Ayten travel companion app
Prohibited Use
You agree not to:
- Use the Service for any commercial purpose without written permission
- Reverse engineer, decompile, or attempt to extract the scoring algorithm or source code
- Scrape, crawl, or automate access to the Service or its APIs
- Abuse rate limits or attempt to overload our systems
- Impersonate another person or misrepresent your identity
- Use the Service in any way that violates applicable laws
- Interfere with or disrupt the Service or its infrastructure
5. Location Services
Dowser requires access to your device's location services to function. By using the app, you acknowledge that:
- Location access is required for route generation and navigation guidance
- You are responsible for your own safety while walking any route
- Routes may pass through areas that are unfamiliar to you — always be aware of your surroundings
- Dowser is not a navigation app and does not provide turn-by-turn directions
- You should not use the app while crossing streets, in traffic, or in situations requiring your full attention
6. Intellectual Property
The Dowser app, including its scoring algorithm, route generation pipeline, user interface, design, and branding, is owned by Ayten and protected by intellectual property laws.
You retain ownership of your personal data, ratings, and preferences. By using the Service, you grant us a license to process this data solely to provide and improve the Service.
Venue data is sourced from third-party providers (Google Places) and is subject to their respective terms.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Specifically:
- Routes are suggestions, not guarantees of a safe or pleasant walk
- Venue information (hours, availability, conditions) may be outdated or inaccurate
- Walking involves inherent physical risks — exercise appropriate judgment
- We do not guarantee uninterrupted availability of the Service
- Discovery results depend on available venue data, which varies by city and neighborhood
Walk at your own risk. Dowser is a discovery tool, not a safety guarantee. Always be aware of your surroundings, obey traffic laws, and use common sense while walking.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYTEN SHALL NOT BE LIABLE FOR:
- Any injury, accident, or harm that occurs while following a Dowser route
- Indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Inaccurate venue information or closed/unavailable destinations
- Third-party service failures (Google, Mapbox, AWS)
Our total liability shall not exceed $50 USD.
9. Termination
You may stop using Dowser at any time by uninstalling the app. You may request account deletion by contacting us.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) will continue to apply.
10. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of Dowser after changes constitutes acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you through the app.
11. Governing Law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in courts located in Travis County, Texas.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ayten regarding the Dowser Service.
